British Pensioners Lost Court Battle
13 UK retirees have lost their long running battle to establish index linked pensions rights despite the fact that they have chosen to retire abroad.Currently the law states that pensioners who chose to live in another country whilst drawing their pensions will have their pensions frozen at the rate payable when they expatriated.
After years of fighting, the pensioners eventually took their case to the European Courts in Strasbourg where Judges have just ruled that denying index-linked rises to pensioners who have expatriated does not breach their human rights.
Only pensioners who retire abroad to countries with which the UK has reciprocal arrangements such as the 26 EU countries, Iceland, Norway, Turkey, Lichtenstein and Switzerland will receive inflation linked pension rises. Pensioners who move to Australia, New Zealand, South Africa and Australia will not have their pensions index linked.
